By accessing or using BrandVia ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of the terms, then you may not access the Service.

2. Description of Service

BrandVia provides URL shortening, custom domain management, and link analytics services. We reserve the right to modify, suspend, or discontinue the Service at any time, with or without notice.

3. Accounts

When you create an account with us, you must provide us information that is accurate, complete, and current at all times. Failure to do so constitutes a breach of the Terms, which may result in immediate termination of your account on our Service.

4. Acceptable Use

You agree not to use the Service to:

• Upload or distribute content that is illegal, harmful, threatening, or abusive.
• Spam, phish, or distribute malware.
• Infringe upon the intellectual property rights of others.
• Interfere with or disrupt the integrity or performance of the Service.

We reserve the right to remove any link and suspend any account that violates these policies.

5. Intellectual Property

The Service and its original content, features, and functionality are and will remain the exclusive property of BrandVia and its licensors.

6. Limitation of Liability

In no event shall BrandVia be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the Service.

7. Fair Use Policy

BrandVia is designed for legitimate business and personal use. We strictly prohibit the use of our service for:

• Spamming, phishing, or distributing malware.
• Redirecting to illegal or age-restricted content without proper gating.
• Generating excessive traffic that disrupts our infrastructure (DDoS).
• Creating an unreasonable number of links or API requests that exceed typical human or business usage patterns.

Violating this policy will result in the immediate termination of your account and banning of your IP address.

8. Subscription & Payments

Processing: Payments are processed securely via Stripe. We do not store your credit card information on our servers.

Recurring Billing: Paid subscriptions (Pro, Team) are billed in advance on a monthly or annual basis. Your subscription will automatically renew at the end of each billing cycle unless you cancel it.

Price Changes: BrandVia reserves the right to adjust pricing for our service or any components thereof in any manner and at any time as we may determine in our sole and absolute discretion. Any price changes will take effect following email notice to you.

9. Cancellation & Refunds

Cancellation: You may cancel your subscription at any time via your account dashboard settings. Cancellation will take effect at the end of your current billing period. You will retain access to paid features until that time.

Refunds: BrandVia offers a 7-day money-back guarantee for new Pro subscriptions. If you are unsatisfied for any reason within the first 7 days, please contact support for a full refund. After 7 days, payments are non-refundable, and we do not provide credits for partial months.

10. Disputes & Chargebacks

If you have a billing issue, please contact our support team at billing@brandvia.app before initiating a dispute with your bank. We are committed to resolving legitimate billing errors quickly.

Initiating a chargeback without prior communication may result in the immediate and permanent suspension of your account and all associated links.

11. Governing Law

These Terms shall be governed and construed in accordance with the laws of Delaware, United States, without regard to its conflict of law provisions.
